1. About these terms
These Terms & Conditions (the “Terms”) apply to the KATTITTA website and to every KATTITTA system you sign up for or use, including The KYC Hub and E-Invoice (together, the “Services”). By creating an account, sending a KYC request, completing a KYC request, or otherwise using the Services, you agree to these Terms.
If you use the Services on behalf of a business, you confirm that you are authorised to accept these Terms for that business.
2. Definitions
- “We”, “us”, “our” or “KATTITTA” means the provider of the Services.
- “Company” means the business that subscribes to and uses the Services, for example a dealer in precious metals and stones.
- “Client” means a customer of the Company who receives and completes a KYC request sent through the Services.
- “Attachment data” means documents and files uploaded to the Services, such as trade licences, passports, Emirates IDs and declarations.
- “Premium” means a paid subscription plan. “Free” means use of the Services without a paid plan.
3. Mandatory service terms
The following terms apply to all KATTITTA systems wherever the feature they describe is offered. They take priority over anything else in these Terms that might seem to say otherwise.
Mandatory service terms
- Premium customers’ attachment data will be stored until the period ends. They will have an option to download it anytime.
- Premium subscription will be activated only once the payment is confirmed.
- Once the premium ends, unless renewed, they will have an option to download the data for 14 days, after which it will be removed.
- If not renewed within 14 days, and renewed later, it will be considered as a new account, and all features except premium features will be started as a new customer.
- If you are using the system free, the attachments with client KYC requests will expire and be removed from the system in 14 days.
- Clients are responsible for providing accurate data. The Company is responsible for verifying the accuracy of the data.
- The Company agrees to provide correct information. Any loss to us due to inaccurate data will be indemnified to us by the Company.
- The Company agrees to submit the data to clients through KYC requests.
- We may share the data with any outside agencies under legal obligations.
4. Accounts
You must give accurate information when you create an account and keep it up to date. Keep your login details confidential, and tell us straight away if you believe someone has accessed your account without permission. You are responsible for activity carried out under your account.
5. Free and premium plans
Some features are available free of charge and others only on a premium plan. Free use is subject to the limits in the mandatory service terms above, including the removal of attachments with client KYC requests after 14 days. Premium plans run for the period you purchase.
Payments and activation
Premium subscription will be activated only once the payment is confirmed. Where a payment method takes time to clear — for example a cheque or bank transfer — activation happens after we receive confirmation of the funds. Prices, taxes and payment options are shown at the time of purchase.
When a premium plan ends
Once the premium ends, unless renewed, you will have an option to download your data for 14 days, after which it will be removed. If the plan is not renewed within 14 days and is renewed later, it will be considered as a new account, and all features except premium features will be started as a new customer.
6. Data accuracy and responsibilities
Who is responsible for the data
- Clients are responsible for providing accurate data. The Company is responsible for verifying the accuracy of the data.
- The Company agrees to provide correct information. Any loss to us due to inaccurate data will be indemnified to us by the Company.
- The Company agrees to submit the data to clients through KYC requests.
The Services help the Company carry out its own customer due diligence, screening, reporting and invoicing. Risk scores, screening matches, reports and calculations support the Company’s decisions; they do not replace the judgement of the Company’s compliance officer or its other legal obligations. The Company remains responsible for its own regulatory compliance, including under UAE anti-money laundering and tax laws.
7. Your own records
Because attachments are removed after the periods described in these Terms, you are responsible for downloading and keeping your own copies of any records you are required by law to retain, for as long as the law requires.
8. E-invoicing and third-party services
E-Invoice exchanges invoices through Accredited Service Providers (ASPs) over the Peppol network and reports tax data in line with UAE requirements. Accreditation, validation, delivery and reporting may depend on third parties such as ASPs, network operators, payment providers and government systems. We are not responsible for delays or failures caused by those third parties, but we will help you resolve issues where we can.
9. Acceptable use
You must not use the Services to break the law, to upload content you have no right to share, to attempt to access another company’s data, to interfere with the security or operation of the Services, or to reverse engineer them except where the law allows.
10. Intellectual property
The Services, the KATTITTA name and logo, The KYC Hub and E-Invoice names and logos, the website and the brand film belong to KATTITTA or its licensors. You may use the Services only as these Terms allow. Your data remains yours.
11. Availability and changes to the Services
We work to keep the Services available and secure, but we cannot promise they will be uninterrupted or error-free. We may improve, change or retire features, and we will give reasonable notice of changes that materially reduce what a paid plan includes.
12. Indemnity
The Company agrees to provide correct information. Any loss to us due to inaccurate data will be indemnified to us by the Company. The Company also indemnifies us against losses arising from its breach of these Terms or of the law.
13. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, loss of profit or loss of data that could have been avoided by downloading it within the periods described in these Terms. Nothing in these Terms limits liability that cannot be limited under UAE law.
14. Suspension and termination
You may stop using the Services at any time. We may suspend or close an account that breaches these Terms, that is used unlawfully, or where we are required to do so by law. The data provisions in the mandatory service terms continue to apply after an account ends.
15. Sharing under legal obligations
We may share the data with any outside agencies under legal obligations. See our Privacy Policy for more detail.
16. Governing law
These Terms are governed by the laws of the United Arab Emirates. Disputes will be handled by the competent courts of the United Arab Emirates.
17. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top shows when they last changed. If a change is significant, we will tell account holders before it takes effect.
